Q. What is a No Fault Divorce?
A. A no fault divorce is granted on the basis that either side shows the marriage is "irretrievably broken." Under the previous law financial settlements were based on fault. Under the new law financial settlements are based on need, ability to pay, contribution to the family economy, and special circumstances.
Q. Can both sides have the same lawyer?
A. One lawyer may not represent both parties in a divorce action. In certain circumstances a lawyer representing one of the parties may prepare all the paperwork and filings, but that lawyer does not represent both parties.
Q. Who long does it take to make the divorce final?
A. Once the petition is filed it will take at least 60 days until the actual court hearing.
